Terms of Service — Fluency in Action Upload
1. What this document is, and an honest note about it
Fluency in Action Upload (“the Application”) is an internal command-line tool operated by Lunex AI Solutions, a sole proprietorship registered in Denmark (https://lunexaisolutions.com) (“we”, “us”, “our”).
The Application has exactly one user: its operator. It is not distributed, sold, licensed or offered to anyone. It has no accounts, no sign-up, no public interface and no server component. There is therefore no third party for us to form an agreement with, and in the ordinary sense these terms govern nothing.
They exist because the YouTube API Services audit process asks for Terms of Service documentation, and because the honest way to answer that request is to state plainly what the Application does, who may use it, and what rules bind its operation — rather than to publish a contract with imaginary users. Read this as a statement of operating terms, and section 4 in particular as commitments that genuinely bind us.
If the Application is ever offered to anyone else, this document must be replaced with real terms before that happens, and the change notified to YouTube as required by the YouTube API Services Developer Policies.
2. Who may use the Application
Only the operator. Use by any other person or system is not authorised.
The Application may be used only to publish video content that we ourselves produced, to YouTube channels that we ourselves own and control. It may not be used to publish anyone else’s content, to publish to anyone else’s channel, or on anyone else’s behalf.
3. What the Application does
The Application uploads finished video files from local storage to our own YouTube channels via the YouTube Data API v3, and sets each video’s title, description, tags, category, “made for kids” declaration and visibility. All of that metadata is written by us in advance, in a local manifest, and is not derived from YouTube data.
It requests two OAuth scopes and no more:
youtube.upload— to publish our videos to our channels.youtube.readonly— used solely to read back the authorized channel’s id and title so the Application can confirm it is about to upload to the intended channel. We operate six channels whose names differ by one word, and the OAuth consent screen cannot be pre-set to a specific channel; without this check a mis-selection would be silent and would publish a lesson to the wrong language’s audience. The Application refuses to proceed on a mismatch.
4. Rules that bind our operation of the Application
These are commitments, not disclaimers:
- We use YouTube API Services in accordance with the YouTube API Services Terms of Service, the YouTube API Services Developer Policies, and the YouTube Terms of Service.
- We do not access, collect, store or process any person’s data other than the operator’s own OAuth credentials. We read no viewer, subscriber, comment or analytics data.
- We do not retain any YouTube API Data after an upload completes. We operate no database, no cache and no backup of API data.
- We do not share, sell, rent, license or transfer API Data to any third party. There are no subprocessors.
- We do not use API Data for advertising, and we do not use it to train, fine-tune or evaluate any machine learning model.
- We do not attempt to circumvent, and will not build anything that circumvents, YouTube’s rate limits, quota, monetisation, or the ordinary YouTube user interface.
- We will notify YouTube in writing of any material change to the stated use case, and seek approval before continuing under a changed use.
5. Content and responsibility
All content published through the Application is produced by us and we are solely responsible for it, including its accuracy, its rights clearance and its audience declarations. We publish our educational content as not made for kids, as it is written for adult and teenage language learners.
6. Credentials
The OAuth client secret and refresh tokens are stored only on the operator’s local computer, with restrictive file permissions, excluded from version control, and never logged or displayed. Access may be revoked at any time via https://myaccount.google.com/permissions or by deleting the stored tokens.
7. No warranty; termination
The Application is provided as-is for internal use, with no warranty of any kind. We may stop using it at any time. Google may suspend or terminate our API access if the Application is found to be non-compliant with the YouTube API Services Terms of Service or Developer Policies, and we accept that.
8. Privacy
Data handling is described in full in our privacy policy: https://lunexaisolutions.com/privacy/youtube-api
9. Governing law
These terms are governed by the laws of Denmark.
